Witness Backs Police Account Of Shooting

DAYTON, Ohio -- Althea Greene was on her front porch on West Parkwood Avenue on Saturday night, July 19, when she saw a fight develop across the street involving a Dayton police officer and a man.

The combatants, it turned out, were rookie Officer Jack Brooks and Ricky L. Moore. In seconds, she saw the officer shoot Moore and watched Moore fall to the sidewalk. She telephoned 9-1-1 as they fought.

In a recording of that call that can be heard via DaytonDailyNews.com, the 33-year-old woman is calm until gunshots ring out. Then, the urgency of her request to have police sent becomes nearly frantic.

Tuesday, July 22, she said she doesn't think the officer had a choice in the shooting.

"The guy was kicking his ass," she said. Brooks "had no choice. He (Moore) was going after the officer a second time."

Greene, who said she gave police investigators a complete statement, wasn't the only one watching about 10:20 that night. A well-attended child's birthday party was happening a few doors away.

In accounts from witnesses gathered by the Dayton Daily News, not everyone saw the same thing. Details vary. Witnesses were at various distances, viewing a scene illuminated by the head lights of a parked police cruiser.

There's disagreement about the moments before Moore was shot, whether he had an object in his hand. Some say he was empty-handed and backing up to leave after wrestling with Brooks. In contrast to a police version of events, others said they didn't see Moore armed with the officer's Taser.

Police Chief Richard Biehl, in a press conference on Monday, said Brooks, 22, told investigators that he believed Moore, 35, was armed -- possibly with a handgun. Biehl said Brooks told investigators that he lost his Taser while wrestling with Moore after Moore attacked him.

Biehl said an initial investigation shows that the Taser was found next to Moore where he fell, shot by Brooks from about 18 feet away.

As the official investigation continues into the fourth police officer-involved shooting since May, neighbors and witnesses want a fuller explanation of why Moore was shot dead. Neighbors and witnesses also are wondering aloud whether the incident could have been handled differently.
