DAYTON, Ohio -- A local high school teacher and football coach has been suspended for five days without pay as of today, July 2, over an incident in May where he allegedly had a physical confrontation with a student.

Dunbar High School teacher James Lacking is accused of shoving a student for the second time in three months.

The district issued the suspension with a letter addressing an alleged incident on May 22 between Lacking and a 15-year-old student. 

The teen said Lacking threw him against a white board, shoved him, and tried to provoke him into striking the teacher.  Witnesses said Lacking yelled and shoved the boy.

Lacking, who has been employed with the school since 1997, was reprimanded in March for an incident in which he shoved a student for being disrespectful.

School officials will hold a hearing Monday, June 4, where Lacking said his fate in the Dayton Public School district will likely be decided.

Two Injured After Mustang And Dump Truck Collide

DAYTON, Ohio -- A woman spent nearly half an hour stuck inside her vehicle after a collision with a dump truck.

Police and medics were first called to Shroyer and Patterson roads at 3:43 p.m. today, July 2.  The driver of a Mustang was taken to Miami Valley Hospital after crews removed her -- a passenger was also hospitalized.

The driver of the dump truck was not injured.

The conditions of the injured parties is unknown and police are still investigating the cause of the crash.


Elderly Woman Died After Mistaking Heat For AC

CINCINNATI, Ohio -- An elderly Cincinnati woman died because of extreme heat last week after she turned on her heat instead of her air conditioning, according to the Hamilton County Coroner.

Fannie Shockley, 84, apparently misread her thermostat last Tuesday, June 23, and turned on the furnace while temperatures were as high as 87 degrees Fahrenheit outside.

The coroner said the incident was the first heat-related death in the city this year.

BROOKVILLE, Ohio -- After the massive turnout for the Dayton Tea Party in April, the organizers are holding a similar event in Brookville on Friday, July 3.

The rally is scheduled for 7 p.m. at Golden Gate Park in Brookville located at 750 Arlington Road.

Speakers for the event include Rep. Jarrod Martin, R-Beavercreek and University of Dayton History Professor Larry Schweikart.  The event will end with a fireworks display.

The city estimated a cost of $3,500 to $4,000 to pay for extra police patrols -- the organizers of the event signed an agreement to cover the costs.


City Rejects Recommendation On Raises For Police

DAYTON, Ohio -- The wage dispute between city commissioners and the Dayton's police union will go on after recommendations from an independent fact-finder were turned down.

The recommendation was to provide Dayton police a 1 percent wage increase and no mandatory unpaid leave -- officials with the Fraternal Order of Police said they were willing to accept those terms. 

Dayton, which announced last month it was facing a mid-year deficit of $4 million, has asked all city employees to forego their 3 percent raises and take four days of unpaid leave to help make up the difference.  The police and firefighter unions have both rejected those terms so far.

City Manager Rashad Young said the issue will be put to another third-party arbitrator and he will go along with whatever is decided.  Young also said the same method will likely be used for the fire union.


DAYTON, Ohio -- A man learned his sentence today, July 2, after he was convicted last month of murder in the killing of 20-year-old David Driscoll in a gas station parking lot in February.

Kyle McClendon, 23, will serve 27 and a half years to life in prison in the Feb. 8 incident at the Marathon gas station on Riverside Drive. 

McClendon's attorneys admitted in the trial that he shot Driscoll, but argued that Driscoll was the aggressor in the slaying.  Judge Dennis Langer dismissed that defense, saying McClendon was clearly the aggressor.

Surveillance footage of the killing appears to show Driscoll and McClendon getting ready to fight, but the two instead shake hands and hug.  Driscoll then started walking towards McClendon's car, and the McClendon shot him.

Two friends of Driscoll testified that the disagreement had started when McClendon bumped into one of them, and Driscoll said something to him.

At the time of the shooting, McClendon had just been granted probation in lieu of a conviction for carrying a loaded concealed weapon only about a month before the shooting.  His sentence included 18 months for possessing a weapon under probation.


Man Helps Out Elderly Woman, Then Steals Her Purse

SPRINGFIELD, Ohio -- A man is wanted by deputies for helping an 86-year-old woman with her groceries, then taking off with her purse.

It happened Monday, June 29, at the Kroger grocery store at 2728 East Main Street. 

Deputies say a man approached the elderly woman and asked for help finding his vehicle.  He helped her with her groceries before grabbing her purse and fleeing, according to the police report.

The man is described as a thin male in his early 20s, around 6'3" with brown hair.

Anyone with information about the incident is asked to call 328-2560.


EATON, Ohio -- Like many area law enforcement agencies, the Preble County Sheriff's Department is facing more budgets, which could mean fewer jobs.

Sheriff Mike Simpson said the county is looking at an 8 percent cut over the next few weeks, which he said would prevent him from keeping residents safe.

If forced to make more cuts, Simpson said he will likely have to cut patrols and a dispatcher position.


Local Man Dies Of Swine Flu

HAMILTON, Ohio -- Ohio's first confirmed death from the H1N1 virus is in Butler County, according to information from the Ohio Department of Health.

The ODH has now confirmed that a 46-year-old Hamilton man died Monday, June 29.  Like most of the confirmed fatalities from the virus, the man did have underlying health issues that may have contributed to his death.

Greene County also confirmed its first case of the virus today, July 2, in a 12-year-old girl.  Sarah Pappa with the Greene County Combined Health District said she has been at home and is recovering -- it's not believed there are any other potential cases in the county.

According to the World Health Organization, as of July 1 there have been 332 deaths from the H1N1 virus worldwide, 127 of which have been in the United States.

Steps to prevent the spread of H1N1 are the same as for the seasonal flu: cover your mouth when you cough or sneeze, wash your hands, and stay home if you are sick.


Chemical Disaster Averted At Moraine Train Yard

MORAINE, Ohio -- An overnight train derailment nearly caused a dangerous chemical leak in Moraine.

It happened just before midnight Wednesday, July 1, at the CSX Transportation yard off of State Route 741 near West Dorothy Lane.  Workers were moving train cars around to prepare them for transportation when several derailed, puncturing a chemical tanker.

Luckily, the damage was limited to the outer shell of the car -- the inner tank containing the hazardous material was not damaged.  The car was carrying acetone cyanohydrin, a highly dangerous compound used in the production of acrylic.
