While the 1898 case of Wong Kim Ark is often brought up in discussing this area of law, the fact is that its ruling (the only thing that counts as precedent, even though Justices will go on and on with discussions called "dicta") only operated in the realm of CITIZENSHIP. Plain vanilla citizenship. The singular case which deemed someone a "natural born citizen" as part of its ruling was decided in 1939, in Perkins v. Elg. Miss Elg had been born in the U.S., her Swedish immigrant parents had become naturalized by the time of her birth with her father undergoing "naturalization" which, at the time under the relevant statutes, operated to also "naturalize" a wife. Thus the ruling recognized the following two conditions for "natural born citizen":<br> Birth on U.S. soil<br> Birth to two parents both of whom are citizens at the time of the birth.<br> <br> It's not known why Mr. Obama appears to have blocked access to many of his records; it is indisputable that he is the least scrutinized man ever to be elected U.S. President in terms of reporters being given access to the kind of records that they have had from past candidates. If his parents were indeed married on the date of his birth, he does not pass the only known definitional standards rendered to date (the Elg case) as a "natural born citizen" because of the dual citizenship that both FactCheck and "FightTheSmears" claim. If his mother was NOT married, or if the marriage should be deemed invalid (annulled) due to a problem of "bigamy" rendering it thus, then his sole heritage for purposes of citizenship might look solely to the mother, and render him a "natural born citizen."
